Man ordered to stop releasing Charter data.

Jose Proenza-Sanfiel wants to sell the patient information he says he found on a computer.

A state judge has ordered an Osceola County man and three Orlando television stations to stop releasing information about patients of Charter Hospital Orlando South.

Jose Proenza-Sanfiel, who said he found the information on a computer he bought, vowed Tuesday to defy the court order.

Proenza-Sanfiel, who said he used to work at the psychiatric hospital in Kissimmee, wants to be paid for the information. He said he would consider giving the records to Charter for $20,000, or to the federal government for a fee. The files, he said,

might help the government in an insurance-fraud lawsuit it has pending against Charter. Joe Krovisky, a spokesman for U.S. Justice Department, said the agency is aware of Proenza-Sanfiel's claims and is looking into them.

Stephen J. Calvacca, an Orlando lawyer representing the hospital was more forceful: "Is there something in my voice that tells you I want to be a victim of extortion?"

In ordering Proenza-Sanfiel to stop giving out patient information, Circuit Judge John H Adams Sr. was responding to a Charter lawsuit that seeks to recover the files. That suit, filed Monday in Orlando, accuses Proenza-Sanfiel and the TV stations of violating state laws that protect patient confidentiality.

The suit is unrelated to the government's case accusing Charter of billing Medicare for unnecessary treatments. Proenza-Sanfiel said he found patient records on a computer he bought several months ago at a Kissimmee thrift shop. A spokes-

and no workers remember selling such an item There's some serious question in the mind of Charter Hospital as to the true circumstances under which this gentleman obtained these records," Calvacca said. Proenza-Sanfiel was not a direct employee of Charter, Calvacca said, but he might have worked there under a contract with an outside agency.

Charter is trying to verify whether the information Proenza-Sanfiel has originated at the hospital. Joel Weiden, a company spokesman based in New York, said the most sensitive data about clients, such as diagnoses, progress notes and treatment files, is not computerized.

But Buss Kilgore, news director at WESH-Channel 2, said the station's reporter saw confidential medical information on the computer.

Charter treats adults and children with psychiatric and substance-abuse problems. Founded in 1989, the 60-bed facility has about 100 employees. It is owned by Charter Behavioral Health Systems, a subsidiary of Magellan Health Services in Atlanta.

Proenza-Sanfiel's CO-defendants are his wife, Judy Proenza-Sanfiel; WESH; WFTV-Channel 9; WCPX-Channel 6; and several unidentified individuals listed as "John Doe."

On Tuesday, WESH asked the judge to reverse his order because it violates freedom of for WFTV said the request today.

Before now, Proenza-Sanfiel was perhaps best known for persuading the Florida Legislature to designate U.S. Highway 1 from Key West to the Georgia border as the POW/MIA Blue Star Memorial Highway.

The Cuban-born Marine Corps veteran also made the news in 1993, when he went on a hunger strike to protest U.S. plans to lift sanctions against Vietnam.

He lived in a bamboo cage near the Orlando Naval Training Center for 25 days. In 1988, Proenza-Sanfiel founded BUMP-IT (Ban Unconstitutional Mandates Prohibiting Individual Thought), a group that fought a Florida law against obscene bumper stickers. He once received a ticket for displaying a "Russia Sucks" sticker on his pick-up.

"I'm not the kind of person you step on," Proenza-Sanfiel said. "If you step on me, I'll sting you back."

This article was the first one that was written with any input from me. Even though it is headed by two reporter's I only Rmemember speaking to one.

I was faberglasted when I saw this article. I wrote a letter right away to the reporter and the editor. Since while I was speaking with her I specifically asked that my name be kept confidential. Due to the fact, that we were dealing with psychiatric patients. Don’t get me wroong folk's. Even though most folk's are in need of minor Mental Tune-up's there was always the chance of the usual 10% that are truly mentally ill. Who knows what they would do if believed that I was releasing patient data about them.

Well as you can see she did not keep my name confidential.

Not only that but she also misquoted me by saying that I wanted to sell the information to Charter. In actuality the matter was simply put as a question of If...If....If....If.

I really do not know what happened here since I had read about Reporter's going to jail before they revealed their confidential sources. As far as I'm concerned this person or persons that signed their name to this story do not really deserve the name of professional Journalist.

I know that the Editor in chief is a good Man. Charlie Reese and we have had some contact. Even a very nice article written about me by him in regards to the POW/MIA Issue. I can certainly see how is it that the Orlando Sentinel has gained the nickname of the Orlando Slantinal by the local community. ( I have personally believed that they do a fair job and will refuse to Judge all of the persons working there just by one or two misguided children ) However; I was not the one to give the paper its nick-name either. As in all things You be the Judge.

Also should be noted that the so called Government investigator Joe Krovisky,...must be doing his investigation telepathically cause I do not ever remember speaking with this person.

Further note should be placed on the end of the article where some thing's are said about my previous adventures into activism and consumerism and when they did the previous reporting they had been pretty fair and accurate.

One thing that really concern's me is the fact that this Story was written on the Business section of the paper and not in another area such as Human interest or Computer Section of the paper. This article is an indicator that all that every one seems to be concerned in this case IS THE MONEY HONEY. ( Except for this caring Nurse whom lately has had to pay more attention to the cold hard cash due to this whole fiasco ). Perhaps if the story was written by a reporter from another section of the paper there would of been a better response and responsibility.
